General Terms and Conditions

Welcome to Taqdeer Valuation Services. By submitting a valuation request through our platform, you agree to be bound by the following terms and conditions. Please read them carefully before proceeding.

These terms constitute a legally binding agreement between you ("Client") and Taqdeer ("Company") regarding the provision of professional valuation services for real estate properties and industrial equipment.

Acceptance of Terms

By submitting a request, you confirm that you have read, understood, and agree to these terms.
You confirm that you are at least 18 years of age and have the legal capacity to enter into this agreement.
If submitting on behalf of a company, you confirm that you have the authority to bind the company to these terms.

Modifications

Taqdeer reserves the right to modify these terms at any time. Continued use of our services after such modifications constitutes acceptance of the updated terms.

Taqdeer provides professional valuation services for the following categories:

Professional Standards

All valuations are conducted by certified appraisers in accordance with:

Saudi Authority for Accredited Valuers (TAQEEM) standards
International Valuation Standards (IVS)
Royal Institution of Chartered Surveyors (RICS) guidelines where applicable

Pricing and Payment Terms

Pricing Structure

Valuation fees are determined based on the type, size, and complexity of the asset.
A detailed quotation will be provided after reviewing your request.
All prices are quoted in Saudi Riyals (SAR) and are exclusive of VAT unless otherwise stated.
Additional fees may apply for expedited services, site visits to remote locations, or specialized valuations.

Payment Terms

Payment is required in advance before the valuation work commences.
Payment can be made via bank transfer, credit card, or approved payment gateways.
Payment links are valid for 48 hours from the date of issuance.
The valuation report will only be released upon confirmation of full payment.

Invoicing

A VAT-compliant invoice will be issued for all transactions in accordance with Saudi Arabian tax regulations.

Client Obligations

To ensure accurate and timely delivery of valuation services, the Client agrees to:

Information Accuracy

Provide accurate and complete information about the property or equipment.
Disclose any known defects, encumbrances, or legal issues affecting the asset.
Inform us of any recent modifications, renovations, or changes to the asset.

Access and Cooperation

Arrange and provide reasonable access to the property or equipment for inspection.
Ensure the availability of a representative during site visits if required.
Provide relevant documentation (title deeds, building permits, maintenance records, etc.).

Timely Response

Respond promptly to any clarification requests from our valuation team.
Review and approve quotations within the specified timeframe.
Delays caused by the Client may affect the delivery timeline.

Confidentiality and Data Protection

Confidentiality Commitment

Taqdeer is committed to maintaining the confidentiality of all client information. We will:

Treat all information provided as strictly confidential.
Not disclose any client or property information to third parties without consent.
Use the information solely for the purpose of completing the valuation.
Maintain secure records in accordance with industry best practices.

Data Protection

In accordance with Saudi Arabian data protection regulations:

Personal data is collected and processed only for legitimate business purposes.
Data is stored securely with appropriate technical and organizational measures.
You have the right to request access to, correction, or deletion of your personal data.
Data retention periods comply with legal and regulatory requirements.

Exceptions

Confidentiality obligations do not apply to information that is:

Already in the public domain through no fault of Taqdeer.
Required to be disclosed by law, regulation, or court order.
Disclosed with the Client's prior written consent.

Valuation Report and Usage

Report Delivery

The valuation report will be delivered electronically in PDF format.
Hard copies can be provided upon request for an additional fee.
Standard delivery time is 5-7 business days from the date of site inspection.
Expedited delivery options are available at additional cost.

Report Usage

The valuation report is prepared exclusively for the stated purpose.
The report should not be used for any other purpose without prior written consent.
The report is addressed to the Client and may not be relied upon by third parties.
Unauthorized distribution or reproduction of the report is prohibited.

Validity Period

The valuation reflects market conditions at the date of valuation. The assessed value may change due to market fluctuations. The report is generally valid for:

Real Estate: 3-6 months from the valuation date
Industrial Equipment: 3 months from the valuation date

Limitation of Liability

Scope of Liability

While Taqdeer exercises due professional care in conducting valuations:

The valuation is an opinion of value based on available information and market conditions.
Taqdeer does not guarantee that the asset will sell or transact at the assessed value.
Liability is limited to the fee paid for the valuation service.
Taqdeer is not liable for indirect, consequential, or special damages.

Exclusions

Taqdeer shall not be liable for:

Losses arising from inaccurate or incomplete information provided by the Client.
Decisions made based on the valuation report.
Market changes occurring after the valuation date.
Matters outside the scope of the valuation assignment.

Professional Indemnity

Taqdeer maintains professional indemnity insurance to cover any valid claims arising from professional negligence.

Cancellation and Refund Policy

Cancellation by Client

Cancellation by Taqdeer

Taqdeer reserves the right to cancel a valuation request if:

The Client fails to provide required information or access.
The asset is found to be illegal or involved in legal disputes.
Circumstances arise that prevent a fair and accurate valuation.

In such cases, a full or partial refund will be provided based on work completed.

Governing Law and Dispute Resolution

Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia.

Dispute Resolution

In the event of any dispute arising from these terms or the valuation services:

Amicable Resolution: The parties shall first attempt to resolve the dispute through good faith negotiations.
Mediation: If negotiations fail, the dispute may be referred to mediation.
Arbitration: Unresolved disputes shall be submitted to arbitration in Riyadh, Saudi Arabia.
